A 26-year-old Bulawayo man has been dragged to the dock after allegedly raping a 64-year-old wheelchair-bound woman, who had given him a place to sleep over at her Makokoba house.
Nobert Zingovo is answerable to a rape charge as defined in section 65 of the Criminal Law Codification and Reform Act 9:23 after allegedly forcing himself into Alice Phiri.
Bulawayo Magistrate Mark Dzira heard that on 21 August Zvingovo who was drinking beer at the complainant’s house asked for a place to sleep after having one too many and was offered the place by the complainant’s daughter Belina Ncube.
According to the state Zingovo slept for five more days in the complainant’s kitchen and on the sixth day took advantage of his stay at the three-roomed house and as Phiri limped to the toilet at about 0030 hours, he waylayed her on the door.
As the complainant came from the toilet, Zingovo grabbed her by the neck and fell down landing with the left side of the body, which happens to be paralysed.
The court further heard that the complainant screamed but Zingovo quickly strangled her and removed her black skin tight and petticoat up to knee level. He then turned the complainant to face upwards and raped her once.
After the act, Zingovo went back to sleep while Phiri alerted some of her grand daughters who were sleeping with her in the sitting room who then called one of her daughters in the same suburb who made a report to the police.
The police found Zingovo still sleeping and upon arrest he was found with a blood stained T-shirt.
In his defence, Zingovo told the court that Phiri is the one who approached him at night asked him to be intimate with her of which he agreed.
A doctor’s medical report was presented as evidence in court.

The case was deferred to Thursday for further deliberations.
