Police Commisioner General, Augastine Chihuri, has been ordered by the High Court to release with immediate effect a vehicle impounded in an operation code named Mushikashika Wapera.
The High court ruling stated that police had violated the Constitution by continuing to hold a vehicle owned by Raymond Madamombe since February 24 without any legal explanation.
In case HC2226/16, Madamombe had argued that the car belonged to a driving school and was impounded when a driving instructor, Freddy Chitora, was dropping a learner driver close to his office.
Chatora was arrested by the police officers for dangerous parking and was directed to pay a fine at the police station.
Police then took the car and parked it at Chikurubi Support Unit Police Camp refusing to release it even after being furnished with documents proving that the car belonged to the driving school.
Madamombe, in his papers, claimed he had lost business worth $100 daily since the vehicle was impounded.
