Grandson (25) beats up ill granny (85)

AN ailing granny from Bulawayo's Njube suburb was yesterday granted a protection order against her unruly orphaned grandson who is in the habit of assaulting her and other siblings.

Western Commonage magistrate Themba Chimiso heard how Kelvin Muchinwa,25, would soon after drinking beer, assault his siblings and ailing grandmother, Ronica Mhizha,85, and stealing her money realised from her small business.

In her founding affidavit, Mhizha said: "I am the lawful owner of House Number 257 in Njube and staying with my grandchildren who are orphans and one of them is Kelvin Muchinwa.

"He is in the habit of assaulting other children whenever he is drunk and each time I reprimand him, he turns on me taking advantage of my age and ill-health. Kelvin is a thief and recently he stole my money and a grinder and when I confronted him he became violent and started shouting at me threatening to assault me."

Mhizha told the court that she no longer felt safe in her home and pleaded with the magistrate to evict Kelvin from her house. "He has threatened me with death and there is no peace at my own home and everyone including my maid is living in fear. I am applying to this Honourable Court of law for a protection order against Kelvin. I am tired of this boy and I want her out of my house," she said. However, Kelvin denied the allegations.

"I am not a thief and I have never harassed anyone at home. My grandmother is telling lies before this court because I don't drink alcohol and I am not a violent person. I am actually an artist and that is how I eke out a living," he said.

In granting Mhizha the protection order, the magistrate said: "Everyone is entitled to full protection by the law and those allegations levelled against you (Kelvin) are sufficient enough to grant the applicant protection order.

"If you act in violation of this court order it warrants a contempt of court, I will send you to jail for three months. It is a taboo to disrespect elders and by abusing your grandmother you are in a way inviting bad omen upon yourself," said Moyo.
