Sheldon Stephens, 24, first went public about his relationship with Kevin Clash in November, but recanted the allegations after being promised a $125,000 settlement.
He filed a lawsuit when the agreement fell apart.

The first of several young men to name the former voice behind Elmo as a sexual predator is now claiming Kevin Clash baited him into an affair fueled by crystal meth.
The Emmy award-winning “Sesame Street” puppeteer, Clash is accused by Stephens of plying him with drugs during sex when he was just 16.
On multiple occasions, the man behind the cuddly red Muppet sent chauffeurs to pick up Sheldon from his home in Harrisburg, Pa., and deliver him to New York for sex, according to the suit.
Clash's lawyer, Berger on Tuesday called the new suit “meritless and bared by the statute of limitations.”
“Sheldon Stephens, the plaintiff, has already admitted in writing that he had an ‘adult consenual relationship’ with Mr. Clash.
“Clash continues to deny any wrongdoing, and we intend to defend this case forcefully,” Berger added.
The complaint filed Monday in a Pennsylvania federal court says Stephens met Clash, 52, “in or about” 2004 at a social networking event for models and actors.
Clash told Stephens he would help him with his acting career.
The two kept in touch by telephone after their first meeting and later began an affair that lasted several years, the suit says.
“Sheldon did not become aware that he had suffered adverse psychological and emotional effects from Clash’s acts until 2011,” according to the suit.
